What is a bail bond?

A bail bond is a financial arrangement that allows a defendant to be released from custody while awaiting trial in exchange for a monetary payment to the court. When someone is arrested and charged with a crime, they may be held in jail until their trial date to ensure they appear in court as required. However, the legal system recognizes that not all individuals are flight risks or a danger to society, so bail is often offered as a way to secure their release.

Here’s how it works:

1. Arrest: When someone is arrested, they go to jail.
2. Bail Hearing: A judge decides how much money the arrested person has to pay to get out of jail. This money is called “bail.”
3. Paying Bail: There are two ways to pay bail:
   – You can pay the full bail amount in cash.
   – If you can’t pay the full amount, you can hire a bail bond agent who pays most of it for you. You pay a smaller percentage to the agent.
4. Getting Out: Once you’ve paid bail (either in full or through a bail bond agent), you’re released from jail. But you have to promise to show up for your court dates.
5. Going to Court: You have to attend all your court dates. If you don’t, you could lose the bail money or get arrested again.
6. Case Resolution: After your court case is finished, the bail money or collateral (property given as security) is returned, minus any fees.
